Former UBS trader pleads not guilty in UK court

A former UBS trader arrested in London on charges of fraud linked with unauthorized trades that cost the Swiss bank more than $2bn pleaded not guilty Monday to the charges against him.

Kweku Adoboli, 31, pleaded not guilty to two counts of fraud and two of false accounting between 2008 and September 2011 at London's Southwark Crown Court.

The trader was arrested on Sept. 14 after on charges of committing fraud that cost the bank over $2 billion.

The incident pushed then-CEO Oswald Gruebel to resign and damaged the bank's efforts to clean up its image after being involved in a United States tax evasion investigation and sustaining huge losses on subprime mortgages during the financial crisis.

City watchdog the Financial Services Authority and its Swiss counterpart have launched an investigation into why UBS failed to spot allegedly fraudulent trading.

Adoboli's case was delayed last year after he replaced his former lawyers at Kingsley Napley law firm with a new team from Bark & Co., which specializes in fraud cases. McCreath set a provisional trial date for September 3 and remanded Adoboli in custody. He said he was willing to hear an application for bail.

Law firms are finally starting to recover from the recession, but they aren't taking their young lawyers along for the ride.

Even as profits return, cautious partners with one eye on damaged balance sheets and the other on stingy clients plan to hang onto the lean silhouettes they acquired during the downturn.

That means little relief for young associates—who took on hefty law-school loans, only to run into layoffs and stagnant pay in the years since 2008—and fewer chances for new law-school graduates to get in on the ground floor. And the elusive brass ring of partnership has grown more remote.

"What happens if Greece falls apart again?" says Greg Nitzkowski, managing partner at Paul Hastings LLP, an international firm that has reduced entry-level hires by about a third since 2008. "We just think it's prudent to plan as if this coming year is going to be a relatively flat year.…We're not planning for a big upsurge in demand."

Conditions at law firms have stabilized since 2009, when the legal industry shed 41,900 positions, according to the Labor Department. Cuts were more moderate last year, with some 2,700 positions eliminated, and recruiters report more opportunities for experienced midlevel associates.

But many elite firms have shrunk their ranks of entry-level lawyers by as much as half from 2008, when market turmoil was at its peak. Salaries and bonuses for those associates have remained generally flat. Meanwhile, a degree at a top law school can cost $100,000 or more.

Associates at prominent law firms say some of their peers hired during the boom years are happy just to have jobs at all. "The world has changed," says a senior associate at a top firm.

Supreme Court lets tipped employees sue for more pay

The Supreme Court will allow bartenders and servers who make part of their money from tips file lawsuits for more money when they do work that doesn't involve tips.

The high court refused to hear an appeal from Applebee's International, which wanted to overturn a lower court ruling.

Restaurants consider tips part of some employees' salary to get the pay up to the minimum wage. But if a worker spends 20% of the time doing general maintenance and preparation work, they currently get full minimum wage.

Gerald Fast and more than 5,500 other current and former servers and bartenders at Applebee's restaurants sued, saying that opening and closing restaurants, as well as cleaning and stocking, consumed significant work time and Applebee's should pay them additional wages.

The lower courts refused to dismiss the complaint and the high court agreed.

2 charged with insider trading involving law firms

Federal authorities have charged two men with running an insider trading scheme that netted more than $30 million with information stolen from law firms.

Garrett Bauer is scheduled to appear in U.S. District Court in Newark, N.J., on Wednesday afternoon. Matthew Kluger will make his first appearance in federal court in Alexandria, Va.

They're accused of trading on inside information stolen from Wilson Sonsini Goodrich & Rosati, a law firm with offices in Washington, D.C., New York, San Francisco and Hong Kong.

Authorities also allege the decades-long scheme used information stolen from prominent New York law firms Cravath Swaine & Moore and Skadden, Arps, Slate, Meagher & Flom.

Rep. Pomeroy joining DC law firm as health adviser

North Dakota Rep. Earl Pomeroy, who was defeated in his campaign for a 10th term, said he will join a Washington, D.C., law firm next week as an attorney and adviser on health policy.

Alston & Bird, which has more than 800 lawyers, said Tuesday it had hired the veteran Democrat and his House chief of staff, Bob Siggins, to work for its health care group.

Federal law bars Pomeroy from lobbying Congress for a year. Pomeroy said he may do lobbying work once the prohibition is lifted.

He said he doesn't believe he will be asked to advocate policies he opposed as a member of Congress or to represent clients who worked to turn him out of office. Republican Rick Berg, a Fargo property developer and former North Dakota state legislator, defeated Pomeroy in November.

"I want the work that I do in health policy to be consistent with trying to make a better health care system," Pomeroy said. "I have received assurances from the firm that I won't be asked to work on something that I fundamentally don't agree with. . No, I don't intend to sell out."

Murdoch firm to pay Insignia $125 million

Rupert Murdoch's News America Marketing has agreed to pay a whopping $125 million to settle a years-long lawsuit brought by tiny Insignia Systems Inc. that alleged Murdoch's people unfairly interfered and lied in attempt to take business from the Plymouth company, which provides in-store promotions.

The settlement, which is more than Insignia's market value and more than four times its 2009 revenue, was reached a day after the trial commenced before U.S. District Judge John Tunheim in Minneapolis.

The deal was announced after the markets closed Wednesday. Insignia's stock has traded lately at more than $6.50 per share, a five-year high and partly in anticipation by traders that Insignia would win a favorable outcome in light of recent, similar settlements reached by other competitors of News America, which is part of Murdoch's News Corp. holdings. Insignia shares closed at $7.57, up 3 percent in Wednesday's trading.

Daniel Patrick Boyd developed a following in his local Muslim community as believers learned about his time waging war against the Soviets in Afghanistan, and he used that stature to tell young followers about the need for violent jihad, prosecutors said Wednesday.

Boyd has now acknowledged his involvement in supporting and plotting terrorism, pleading guilty in federal court to a pair of charges as prosecutors laid out new details of his activities. The plea provided the government with a crucial conviction against what they have described as a ringleader who guided a Raleigh-area group that sought to wage war against nonbelievers.

Prosecutors said the case illustrated the growing concern of homegrown terrorism.

"The radicalization of Muslims here in our country is a very serious threat," U.S. attorney George Holding said.

More than a half-dozen others have been charged in the case, and most of them were younger than 25 when they were indicted in July 2009, including two of Boyd's sons — Zakariya and Dylan. A trial is scheduled for September. Prosecutors said Boyd is cooperating in the case.

With his once-flowing beard shaven clean and hair slicked back, Boyd tearfully answered a judge's yes-or-no questions before finalizing his guilty plea. He smiled at a few family members in the audience. They declined to comment after the hearing, though his wife has said in the past that he was not involved in terrorism.

Court tells man to stay away from Facebook founder

Facebook founder Mark Zuckerberg has obtained a temporary restraining order against a California man accused of stalking him, his girlfriend and his sister.

A Santa Clara County Superior Court judge on Feb. 1 ordered 31-year-old Pradeep Manukonda of Milpitas to stay away from Zuckerberg and stop contacting him.

Manukonda tried to contact Zuckerberg numerous times in December via letter, e-mail and Facebook, including more than 20 times in one day, Facebook security officer Todd Sheets said in a court declaration. Manukonda also left a note on Zuckerberg's car and was later spotted outside his house, Sheets said.

Guards stopped Manukonda just as he was about to walk up the front stairs to Zuckerberg's Palo Alto residence, where Zuckerberg's girlfriend was inside, according to court documents.

Sheets said he contacted Palo Alto police at the time and that an officer gave Manukonda a verbal stay-away order. Two days later, Sheets says Manukonda sent Zuckerberg a letter at his home and flowers two days after that, despite an in-person interview with Sheets where he promised to stop.

Manukonda did not immediately return messages seeking comment. Facebook confirmed the restraining order but declined to comment.

In the letters included as evidence in the court file, Manukonda pleads with Zuckerberg for a few minutes of his time. Though his requests are vague, he appears to be seeking money to pay for medical treatment for his mother.

1,000 at rally call for overhaul of immigration

These were among the stories shared with more than 1,000 people calling for comprehensive immigration reform at a rally Sunday.

The gathering was coordinated by the San Diego Organizing Project, a faith-based community group.

Sunday’s demonstration followed a rally Saturday at City Hall organized by the Southern California Tax Revolt Coalition, a conservative political group.

“So many people from (Mexico) ignore our rules and come on in,” said Leslie Eastman, a spokeswoman for that group, who said about 100 people attended. “I would like to see enforcement so we can have people here legally.”

The rally on Sunday at Chicano Park was followed by a march to St. Joseph Cathedral.

Dallas EEOC sues Charleston, Raleigh companies in employment harassment case

The U.S. Equal Employment Opportunity Commission has filed a lawsuit alleging sexual harassment against North Charleston-based Alternative Staffing Inc. and a North Carolina construction company, said Weinberg Law Firm, Employment Lawyer Dallas.

The lawsuit, filed Aug. 6, says the companies subjected three women, and possibly others, to a sexually hostile work environment. The three women were employees of Alternative Staffing Inc. and were assigned in 2006 to work at an Orangeburg job site for the Raleigh-based construction firm Clancy & Theys.

The lawsuit says the women were harassed verbally and physically, a violation of Title VII of the Civil Rights Act of 1964. The alleged harassment came from a Clancy & Theys labor foreman who was supervising the women and by employees of a third-party contractor working at the site.

But she said in an e-mail message that while Sergeant Maseth’s death was tragic, the company maintains that it is not responsible. She said that KBR informed the military of the absence of grounding and bonding in the structure nine months before Sergeant Maseth’s death, said John Q. Kelly, New York electrocution attorney.

The report said that Sergeant Maseth, 24, was electrocuted while showering when he came in contact with water pipes that had become energized because of the failure of a water pump that had not been grounded. This week's cell phone atrocity award goes to a Colorado woman who had to be escorted off a plane because she refused to stop yakking on her cell phone. To be fair to the cell phone community, it apparently was a case of DWI, Dialing While Intoxicated. According to the police report, Kimberly C. Graf admitted that her pre-boarding procedures included three beers and two shots at the St. Louis airport.

"She repeatedly took out her cell phone and began making calls on it," according to BonitaNews.com, a Web site for a Florida newspaper. She got a police escort after the plane landed in Ft. Myers, Fla. The long-suffering flight crew decided not to press charges. Seems to us the long-suffering passengers deserved a free drink.

Head of prominent NYC law firm accused of fraud

The head of a prominent law firm was charged in a "stunning, brazen fraud" that reaped at least $113 million in profit by tricking hedge funds into making bogus investments, prosecutors said.

Marc Dreier, 58, was charged in a criminal complaint and by the Securities and Exchange Commission in the alleged sale of fraudulent promissory notes.

"Our complaint alleges a stunning, brazen fraud that targeted some very sophisticated institutional investors," said Linda Chatman Thomsen, director of the SEC's Division of Enforcement.

"Investors big and small should take heed, especially in these difficult economic times, that con artists are out there and may go to elaborate lengths to commit fraud," she said.

Assistant U.S. Attorney Jonathan R. Streeter said the government wants Dreier held without bail. During a brief court appearance, the Manhattan resident's bail hearing was set for Thursday.

"This is a very complicated matter and the facts are beyond reach ... of a sound bite," said defense lawyer Gerald Shargel.

In a related case, Dreier was charged last week in Toronto with impersonation in connection with the attempted sale of $45 million worth of notes to a hedge fund.

The scandal has stunned Dreier LLP, a mid-size law firm that has represented celebrities including retired football star Michael Strahan and former News Corp. publishing executive Judith Regan.

Attorney General nominee to earn $4.6 million

Attorney General-designate Eric Holder will earn $4.6 million from his law firm this year and next, according to financial records he provided to the Senate Judiciary Committee.

The committee, which is preparing for Holder's confirmation hearing on Jan. 15, released the records Wednesday.

Holder will earn $2.1 million this year and $2.5 million next year from the law firm of Covington & Burling, including deferred payments. He listed his total assets at $5.7 million, with no liabilities.

On September 12, 2008, an unprecedented tragedy occurred in Chatsworth, California when Metrolink Train #111 struck a Union Pacific freight train which was traveling on the same tracks. Our hearts go out to the victims. But this tragedy should not have happened. It happened because of human error on the part of Metrolink employees. Unfortunately, as the lawyers of RKA know well, human error by railroad engineers is not at all unique as a cause of commuter rail disasters.

Jerome L. Ringler has greater experience in representing victims of commuter rail and freight train disasters than any other lawyer in the State of California, if not the country. He has served as lead counsel in every one of the largest commuter rail disasters which have occurred in Southern California in the past 10 years.

In the Placentia Commuter Rail Disaster of 2003, Mr. Ringler was appointed by the Court as lead counsel for all of the Plaintiffs. This verdict was the largest in the State of California for a person with the type of injuries Mr. Ringler's client had suffered. This verdict is detailed below in the multimedia section.

Mr. Ringler is currently lead counsel for all plaintiffs in the Glendale Metrolink Derailment Disaster of 2005. This incident was, before September 12, 2008, the largest Metrolink disaster in history. Interestingly, in that case (which involves 11 deaths and dozens of serious injuries), Mr. Ringler has, against all odds, developed testimony proving that, even though a mentally-ill person placed a jeep across the tracks that the Metrolink train was traveling upon, human error on the part of the Metrolink engineer prevented him from stopping the train before hitting the jeep, which caused the train to derail. In other words, while the jeep certainly never should have been on the tracks, the Metrolink engineer would have been able to stop the train before ever striking the jeep had he only been paying proper attention. That case is scheduled to go to trial on June 8, 2009, with Mr. Ringler as lead counsel.

Ethics investigator: Governor's tax break OK

A Nevada Ethics Commission investigator concluded Wednesday that there's no evidence to support a claim by a state Democratic Party official that Republican Gov. Jim Gibbons pressured a local assessor to get an unwarranted property tax break.

Investigator Michel Vavra filed the report in advance of a Sept. 11 Ethics Commission hearing on the complaint over the $39.71 tax bill on 40 acres of land in scenic Lamoille, in Elko County, that Gibbons bought for $575,000 a year ago.

"The evidence does not support the allegations that Gibbons used his position in government to obtain unwarranted privileges," Vavra wrote, adding that the property met all the requirements under state law for the low agricultural use assessment.

Vavra also said there's no evidence that Gibbons or John Marvel, a lawyer and Nevada Tax Commission member hired by the governor to pursue the tax break, pressured the Elko County assessor, adding, "Like any citizen, Gibbons has the right to apply and to receive an agricultural use assessment, if his land qualifies."

Joe Aguirre, who just retired as the county assessor, had said the tax bill without the agricultural assessment would be about $5,000. But Vavra noted that Aguirre's office also had stated the annual bill would have been just under $1,900—and the state Taxation Department had an even lower figure of $711.

Stewart, made yet another pitch to sever or postpone the trial, a request Clark County District Judge Jackie Glass denied. He told the judge he would ask the Nevada Supreme Court to reconsider its denial of his request for a separate or delayed trial.

Glass said a pool of 500 would-be jurors was reduced to about 250 after defense lawyers and prosecutors spent several hours behind closed doors Aug. 25 reviewing answers provided on 26-page questionnaires.

"We did excuse most of the people, if not all of the people, who expressed extreme opinions about the parties, in an effort to have a very efficient jury selection process," Glass said.
